Willard J. Hooper was convicted by a Colbert County jury of sexual abuse of his nine-year-old niece, in violation of Code of Alabama 1975, § 13A-6-66. The code reads in part:

"(a) a person commits the crime of sexual abuse in the first degree if: ... "(3) he being sixteen years old or older, subjects another person to sexual contact who is less than twelve years old."
