DIAL, Justice.

In a jury trial presided over by the Honorable H.F. "Hippo" Garcia, appellant was convicted of murder. Punishment was assessed by the jury at seventy-five years confinement. After the trial, but before sentencing, Judge Garcia was appointed to the United States District Court and resigned as a State District Judge. The Honorable Roy R.
