Appellant (herein Union) seeks review of the trial court's grant of summary judgment in favor of appellee (herein Employer). Our standard of review in such cases is that when reviewing the grant of summary judgment, this Court must determine whether there is any genuine issue of material fact and whether the law was correctly applied.
