The appellant, Robert E. Tonge, appeals from a judgment and order entered by the district court for Sarpy County, Nebraska, finding Tonge guilty of driving while intoxicated, third offense. The trial court sentenced Tonge to imprisonment for a term not to exceed 5 years, a 1 year's suspension of his driving privileges, and ordered him to pay the costs of the action.
