¶ Order modified, on the law, by deleting that part of the order denying the branch of the defendant third-party plaintiff's motion which sought partial summary judgment on the issue of liability in the third-party action and substituting therefor a provision granting that branch of the motion. As so modified, order affirmed insofar as appealed from, with costs to the defendant third-party plaintiff.
