This is a petition for writ of certiorari to review the order of the circuit court sitting in its appellate capacity. We have jurisdiction. Fla.R.App.P. 9.030(b)(2)(B) and 9.100

We regard the sole issue as being whether there exists in Florida the crime of attempted resisting arrest without violence
