Baker brought a declaratory judgment action in Hennepin County District Court seeking to have a second mortgage held by Citizens State Bank of St. Louis Park (hereafter Citizens State Bank) on their farm property (Wind-crest Farms) in Minnetrista declared invalid for lack of consideration, for failure to comply with the truth in lending laws, and for misrepresentation.
