The defendant was indicted for the offenses of armed robbery, theft, armed violence, and aggravated battery. (Ill. Rev. Stat. 1981, ch. 38, pars. 18-2, 16-1(a), 33A-2, 12-4(b)(1).) Defendant then waived a jury. After both the State and defense had rested during the ensuing bench trial, a mistrial was declared because of certain communications...
