JUNELL, Justice.

Appellant Martha Hill Thompson was charged with criminally negligent homicide in the death of a pedestrian, Edwin Wayne Phillips, pursuant to TEX.PENAL CODE ANN. § 19.07 (Vernon 1974). Appellant pled not guilty. A jury found her guilty, assessed punishment at confinement for one year and a $2,000 fine, and recommended probation of both.
