¶ The petitioner landlord, Eight Associates, commenced a summary proceeding in November of 1979 to evict the tenant, Michael Hynes, from apartment 2H located at 230 East 71st Street. The basis of the petition was the failure of Hynes to pay two months' rent. The tenant defaulted and on January 14, 1980, a final judgment was awarded in favor of the landlord.
