Plaintiffs were guarantors on a statutorily required livestock agency bond issued to Vale Livestock Auction Co. (Vale Livestock) by Merchants Mutual Bonding Company. After Vale Livestock's default, the bonding company brought an action in federal district court against plaintiffs on their guarantees.
