This action arose out of defendant Liberty Mutual Fire Insurance Company's (hereinafter Liberty Mutual) failure and refusal to provide coverage to plaintiff Paul Lichter for water damage caused by the rupture of plaintiff's water bed. A complaint in assumpsit was filed on May 15, 1981, wherein plaintiff alleges the failure and refusal of Liberty Mutual constitutes a breach of the homeowner's policy of insurance between the parties...
