GARRISON, Judge.

The defendant, Malcolm Morgan, was charged by grand jury indictment with first degree murder in violation of La.R.S. 14:30. A twelve member jury found the defendant guilty as charged. The sentencing hearing was declared a mistrial by the judge due to the inability of the jury to agree upon a verdict. The judge later sentenced the defendant to life imprisonment without benefit of parole, probation or suspension of sentence. Defendant appeals his conviction...
