This appeal involves an action for an unlawful arrest. Sahid Bahakel sued the City of Birmingham, Franklin Tate, and Marva Gibbs. Bahakel's original complaint, alleging malicious prosecution, was dismissed as to the city and Tate by the Jefferson Circuit Court.
