ODOM, Judge.

This is an appeal from a conviction for capital murder. The jury answered the punishment stage questions under Article 37.071(b), V.A.C.C.P., affirmatively and punishment was assessed at death.

Appellant was charged with having intentionally and knowingly caused the death of a young woman by choking her with his hands and by burying her alive. The facts show that on April 4, 1980, appellant abducted the victim from a shopping...
