MEMORANDUM AND ORDER

CAHILL, District Judge.

This matter is before the Court on defendants' motion to dismiss plaintiff's complaint, pursuant to Fed.R.Civ.P. 12(b)(1) and (6). For the following reasons, this Court grants the defendants' motion.
