Appellant Donald William Dufour was indicted by the Grand Jury of the First Judicial District of Hinds County for the crime of capital murder of Earl Wayne Peeples. The indictment charged that Peeples was killed while Dufour was engaged in the commission of the crime of robbery, the alleged offense having occurred during the early morning hours of October 14, 1982.
