This appeal arises from a personal injury action brought by Ainsworth for $125,000 in damages sustained when he stepped on a piece of lumber and fractured his ankle in a baseball game on a field owned and maintained by the city of Jackson. The jury awarded Ainsworth $4,582 in medical expenses and lost wages, based on a finding that the city was 40% negligent and Ainsworth was 60% contributorily negligent. Ainsworth filed a motion...
