The dispositive issue on this appeal is whether a pathological gambling disorder can serve as the basis for an insanity defense to charges of unlawful entry of a bank with intent to commit robbery or larceny. The district court held that it could not, and on this basis excluded evidence of the condition from jury consideration. On defendant's appeal from his ensuing conviction, we affirm, though on a somewhat different basis...
