Brothers Construction, Inc., as the successful bidder was awarded Contract I of the Jourdan Road Wharf and Transit Shed project by the Board of Commissioners of the Port of New Orleans (the Dock Board). Brothers filed this suit against the Dock Board to recover $75,000.00 Brothers had paid to a subcontractor on the project, but which it had not included in its bid to the Dock Board.
