This is an appeal from an order granting a plea in abatement and dismissing the cause of action against appellees.

Appellees, Pamela Nusom and her supervisor, Kathy Pennick, are employees of the Texas Department of Human Resources. They were aware that Glen and Theresa Clary were operating an unlicensed day care center while advertising that such facility was licensed.
