On October 26, 1980, plaintiff Mickie Bickerstaff fell in the parking lot of a Denny's Restaurant in Tucson. Over a month later, she returned to the restaurant to complain to the management about the incident. On September 4, 1981, she filed a personal injury action against Denny's Restaurant, Inc. alleging negligent upkeep of the premises.
