WINTER, Circuit Judge:

Following a trial before Judge Platt and a jury, appellant Bernard McKeon was convicted in the Eastern District of New York on one count of conspiracy to export firearms in violation of 18 U.S.C. § 371. McKeon was acquitted of eight substantive counts concerning the illegal exportation of firearms. The trial was McKeon's third on these charges, the first two having ended in mistrials.
