We granted certiorari, 463 U.S. 1206 (1983), to review a decision of the Court of Appeals for the First Circuit affirming the issuance of a writ of habeas corpus. The Court of Appeals agreed with the District Court that the trial de novo of respondent Lydon, pursuant to Massachusetts' "two-tier" system for trying minor crimes, would violate his right not to be placed...
