The order of the Appellate Division should be affirmed.

Defendant was indicted for first degree rape and two counts of first degree sodomy, all arising out of a single occurrence. After a jury trial, he was convicted of one count of sodomy and acquitted of the remaining counts. On defendant's motion, the trial court vacated the verdict on the ground of repugnancy.
