On remand from the Supreme Court we review defendant's appeal from his conviction for criminal sexual contact with a minor, contrary to NMSA 1978, Section 30-9-13. Defendant raises three issues on appeal: (1) denial of defendant's right to be present at a critical stage of the trial; (2) failure of defendant's attorney to permit him to testify; and (3) refusal of the trial court to excuse a juror for cause.
