STEPHEN G. CRANE, J.

Michelle Walden (defendant) was convicted, after jury trial, of one count each of robbery, first and second degrees. She makes two motions: pursuant to CPL 330.30 she seeks to set aside the verdict; and under CPL 210.40 she invokes the discretion of the court to dismiss the indictment in furtherance of justice. (See People v Clayton, 41 A.D.2d 204.)
