The principal issue here presented is the proper measure of damages for the use of land pursuant to La.R.S. 38:113, which provides for the control of public drainage channels and the preservation of their efficiency. In this case the defendant parish governing authority was made to compensate the plaintiff landowner for the use of his land in an amount in excess of its actual value.
