HOLDEN, Senior District Judge.

The plaintiff, Elizabeth Derby, has released her claim for compensatory damages but continues her action against the defendant, Town of Hartford, Vermont, pursuant to 42 U.S.C. § 1983 ("Section 1983") seeking a declaratory judgment that the Town of Hartford's loitering ordinance is unconstitutional both on its face and as applied to the plaintiff.
