¶ Order reversed, insofar as appealed from, without costs or disbursements, and motion denied without prejudice to renewal if, within 30 days after service upon the Department of Housing Preservation and Development of a copy of the order to be made hereon, with notice of entry, the latter fails to move in the appointing court for permission to proceed in the Civil Court of the City of New York.
