The plaintiff, Jeffrey Michalak, brought suit against the county of La Salle for personal injuries he incurred in a one-car collision on the Troy Grove blacktop. On November 4, 1980, the plaintiff was northbound on the blacktop when he leaned over to put the ashes of a cigarette he was smoking into the ashtray.
