On December 20, 1978, the Mohave County Grand Jury filed an indictment charging appellant, Robert Lloyd Emery, and Edward Wesley Gilliam with second degree burglary and first degree murder. Appellant was convicted of both offenses following a jury trial. This Court reversed both convictions and remanded the matter to the trial court for further proceedings. State v. Emery, 131 Ariz. 493,
