BEVILACQUA, Chief Justice.

The defendant, Patrick Alexander, was indicted by a grand jury on August 3, 1979. The indictment charged him with delivering a controlled substance in violation of G.L. 1956 (1968 Reenactment) § 21-28-4.01(A)(2)(a). The case was tried before a justice of the Superior Court sitting with a jury, which returned a verdict of guilty against the defendant.
