This is an appeal from a decision of a trial justice of the Superior Court granting the motion of the plaintiff, Gibbs Oil Co. (Gibbs), for a new trial, following a jury verdict in favor of the defendant, George L. Potter (Potter). The jury found that Potter had not executed the personal guaranty of the indebtedness of Potter's Gasoline and Distributors, Inc., as Gibbs alleged.
