OPINION

DEL SOLE, Judge:

This appeal arises from an action instituted by George R.H. Elder (Elder) against Adam Orluck (Orluck) to recover for personal injuries suffered when the motor vehicle which he was driving was "rear-ended" by a motor vehicle driven by Orluck. The Appellant is the Borough of Harrisville (Harrisville) which was joined as an additional defendant by Orluck.
