MEMORANDUM OF DECISION

HOLDEN, Senior District Judge.

Following the appeal of his conviction on a negotiated conditional plea of guilty to the charge of conducting a narcotic enterprise in violation of 21 U.S.C. § 848, the petitioner David Lace instituted the present action claiming deprivation of assistance of counsel. On appeal from this court's denial of relief under the provisions of 28 U.S.C. § 2255, 573 F.Supp. 950
