The allegations are that the plaintiff, a passenger in the Atkinson automobile, was seriously injured by the negligent operation of the vehicle as it left the road and struck a telephone pole and two houses. The plaintiff sued James Anthony Atkinson (referred to henceforth as the defendant), the driver of the automobile, and Wol Kim Atkinson, the owner of the vehicle.
