This appeal involves a claim for damages resulting from an accident which caused the death of Rodney Auton, an employee of Merrill's Contractors, Inc. The deceased was working on a road improvement project in Decatur. He had been assigned the task of checking the grade of a road in conjunction with another workman, Keith Spencer (Spencer).
