This appeal was taken from the judgment notwithstanding the verdict entered by the trial court in favor of defendant/appellee Truly Nolen Exterminating of Houston, Inc. (Truly Nolen) in the underlying wrongful death action. The action arose out of the death of appellant's son, Armando Nava, in the crash of an airplane owned by Truly Nolen.
