Bryan N. Kester appeals a conviction of aggravated first degree murder under RCW 9A.32.030(1) and RCW 10.95.020(7) and (9).

On September 29, 1982, Mr. Kester was hired by the Van Vlecks to pick apples in their orchard. After working 1 1/2 days, Mr. Kester was fired for damaging the apples during the picking process.
