Appeal and cross appeal from the order dismissed (see Matter of Aho, 39 N.Y.2d 241, 248). Judgment modified, on the law, by deleting therefrom the third decretal paragraph and substituting therefor a provision granting summary judgment against defendant Miami and dismissing the complaint against defendant Feinman. As so modified, judgment affirmed, with one bill of costs payable by appellants to the plaintiff. Order modified accordingly...
