In August, 1972, plaintiff contracted with defendant for the construction of 4.17 miles of paving and six bridge structures on I-196 in Allegan County. On December 4, 1972, plaintiff entered into a subcontract with Davco, Inc., pursuant to which Davco would construct the pavement portion of the contract.
