SMITH, Justice.

Otis Franklin Spence III was indicted for the shooting death of his mother, Sarah Jo Spence, and tried before a jury in Richmond County Superior Court. Appellant, who was 19 years old at the time of the offense, was convicted of murder and sentenced to life imprisonment. Appellant failed to pursue a direct appeal following his conviction in November 1982, but on September 9, 1983, he was granted leave to file an out of time appeal of his conviction...
