Plaintiff/appellant, Gray Thigpen, brings this appeal from an order of the court dismissing his action on the ground that it failed to state a claim upon which relief could be granted. Plaintiff's sole enumeration of error is that "[t]he trial court erred as a matter of law in dismissing appellant's complaint for failure to state a claim without first affording appellant a hearing."
