On March 8, 1983, the Etowah County Grand Jury indicted appellant, Roger Dale Houk, for trafficking in cannabis, in violation of § 20-2-80, Code of Alabama 1975. At the conclusion of trial, the court struck count two of the indictment charging appellant with possession of marijuana. The jury returned a verdict of guilty of trafficking in cannabis, and on May 5, 1983, appellant was sentenced to seven years'...
