Appellants Kenneth R. Moats and his wife filed suit in the Circuit Court for Washington County for personal injuries Mr. Moats sustained in an automobile accident involving Kevin Wayne Ashburn. During preliminary proceedings, a motion for summary judgment was granted in favor of Ashburn, leaving his employers, the Washington County Sheriff's Department and the Washington County Commissioners, as the remaining defendants (appellees herein).
