Plaintiffs, Gibbs Construction Co., Inc. and Lawrence C. Gibbs, filed suit alleging that defendant, through the administrative office of the University of New Orleans, improperly awarded a construction contract for alterations to the university's graduate school building. The trial court maintained defendant's peremptory exceptions of no cause of action and no right of action, and dismissed plaintiffs' suit, with prejudice and at their cost. From this...
