Appellant was tried before a jury on a two-count indictment. Count I alleged that appellant had possessed marijuana with the intent to distribute it in violation of the Controlled Substances Act. Count II alleged that appellant had violated the Controlled Substances Act by possessing more than one ounce of marijuana.
