This appeal is from the dismissal of an eviction rule brought by the plaintiff, Adam, Inc. Adam sought to evict its lessee, Dividend, Inc., for non-payment of monthly rentals due under a lease agreement. The trial court found that the provision in the lease concerning written notice of default was inapplicable and that tender of payment was timely and cured any default.
