Walter Lamacki (defendant) was charged by information with rape (Ill. Rev. Stat. 1979, ch. 38, par. 11-1), deviate sexual assault (Ill. Rev. Stat. 1979, ch. 38, par. 11-3) and two counts of armed violence (Ill. Rev. Stat. 1979, ch. 38, par. 33A-2). On the State's motion, the two counts of armed violence were dismissed.
